March 21, 2025, President Donald Trump signed an executive order on March 20, 2025, aimed at initiating the process to dismantle the Department of Education, though its complete elimination would require congressional approval, which has not been detailed as enacted by this date.

This executive order, reported by sources like NPR and Newsweek, directs Education Secretary Linda McMahon to "take all necessary steps to facilitate the closure of the Department of Education and return authority over education to the States and local communities," acting "to the maximum extent appropriate and permitted by law." 

The order does not itself dissolve the department but sets in motion a process to reduce its scope and staff significantly—nearly halving its workforce, with reports indicating that around 1,300 of its approximately 4,400 employees were slated for layoffs or placed on administrative leave starting March 21, 2025. The White House justified this move by claiming the department has spent over $3 trillion since 1979 without improving student achievement, though this is a broad assertion not tied to specific legislation.

Importantly, the Department of Education was established by Congress through the Department of Education Organization Act of 1979, signed into law by President Jimmy Carter. As such, fully abolishing it requires an act of Congress, not just an executive order. 

Trump’s action acknowledges this limitation, as it cannot legally terminate the department’s statutory responsibilities—like administering federal student loans, Title I funding for low-income schools, and special education programs under the Individuals with Disabilities Education Act—without legislative repeal or amendment. Congressional approval would likely need 60 votes in the Senate to overcome a filibuster, a threshold difficult to meet given the current political landscape and bipartisan support for some of these programs.

The executive order appears to be a strategic step to shrink the department’s operations and push for state control over education, aligning with Trump’s campaign promises and conservative goals, such as those outlined in Project 2025. However, without specific legislative text available as of now, it’s not a "law" in the traditional sense (i.e., a bill passed by Congress and signed by the president) but an executive directive with limited immediate legal power to dissolve the agency entirely.
